8. Governing Law
These Terms are governed by the laws of Canada, without regard to conflict of law principles.
9. Cancellation, Rescheduling, and Session Length Policy
Tutor Advance reserves tutoring time exclusively for each student. To protect that reserved time and maintain a consistent schedule for all clients, the following policy applies to all sessions booked through Tutor Advance. By booking a session, clients agree to these terms.
i. 48-Hour Notice Standard (Clients and Tutor)
Cancellations and rescheduling requests must be made at least 48 hours before the scheduled start time.
Requests made with less than 48 hours’ notice may be charged at the full session rate, except in the case of a genuine emergency (see Section iii).
ii. Tutor-Initiated Cancellations
If Tutor Advance must cancel a session with less than 48 hours’ notice for a non-emergency reason, a make-up session of equivalent duration will be provided at no additional cost, scheduled at a mutually convenient time. Tutor Advance will make every reasonable effort to avoid this.
iii. Emergencies
A genuine emergency is an unforeseen and unavoidable circumstance that makes attendance impossible. In emergency situations, Tutor Advance will apply this policy with discretion and understanding, provided notice is given as soon as reasonably possible.
Illness: If a student becomes ill within the 48-hour window, please notify Tutor Advance as soon as reasonably possible. Tutor Advance will handle illness-related cancellations with discretion and understanding on a case-by-case basis.
iv. No-Shows
A no-show occurs when a student does not attend a scheduled session and no notice is provided. No-shows are charged at the full session rate. Repeated no-shows may result in suspension or discontinuation of services.
v. Rescheduling
Rescheduling means changing the date and/or start time of a booked session. Rescheduling requests must be made at least 48 hours in advance. Requests made with less than 48 hours’ notice will be treated as a late cancellation, and the original session fee remains payable, unless the change is due to a genuine emergency.
vi. Shortening a Session
Shortening means reducing the duration of a booked session (for example, from 60 minutes to 30 minutes). Requests to shorten a session must be made at least 48 hours in advance. If the request is made with less than 48 hours’ notice, the fee for the originally booked duration remains payable, unless the change is due to a genuine emergency.
vii. General
This policy exists to ensure fairness, protect reserved time slots, and allow Tutor Advance to provide consistent, high-quality tutoring services. If you have questions about how this policy applies in a particular situation, please contact Tutor Advance.
viii. Recurring Time Slot Stability
Consistent use of reserved time slots is essential for scheduling stability. In cases of repeated cancellations, late cancellations, no-shows, or extended periods of irregular attendance, Tutor Advance reserves the right to pause or release a recurring time slot to ensure fairness and availability for other students.
